Andrea Smalling has filed a lawsuit against Wellstar Health System, Inc. in the United States District Court for the Northern District of Georgia, alleging unlawful employment practices under Title VII of the Civil Rights Act, the Americans with Disabilities Act (ADA), and 42 U.S.C.A. § 1981. Smalling claims that after reporting discrimination by a former executive director, she faced unfair criticism and was eventually terminated due to her complaints and mental health disclosures. The lawsuit seeks economic damages, compensatory damages for emotional distress, and attorneys’ fees.
Smalling alleges that her termination was retaliatory following her filing of complaints about sex and race discrimination as well as disability discrimination with the Equal Employment Opportunity Commission (EEOC). She also contends that her job responsibilities were unjustly reduced upon returning from medical leave for chronic depression and anxiety.
