Bellagio Pools, LLC has been embroiled in a legal battle with its customers, Jesus Marino and Erika Torres, over a breach of contract claim concerning the construction of a swimming pool. The company alleged that Marino and Torres owed money for the pool installation, while the defendants counterclaimed for negligent construction. Following a bench trial, the court ruled that neither party was entitled to recover damages. Bellagio Pools appealed this decision, arguing that the trial court’s findings were unsupported by evidence. The appellate court reversed the judgment on Bellagio Pools’ breach-of-contract claim due to insufficient evidence supporting the trial court’s conclusions about substandard repairs made with “duct tape.” The case has been remanded for further proceedings.
