Ceileth Drucker has filed an appeal in the Court of Appeals of Georgia after a trial court granted summary judgment to defendants Jonathan H. Morgan, 219 Battery Circle, LLC, and Starland Property Management, LLC. Drucker sued for injuries sustained from a falling tree limb while staying at a short-term rental property in Savannah, Georgia. The trial court ruled that the defendants were not liable as they did not own or control the land where the incident occurred. However, Drucker’s appeal argues that questions remain about whether the area constituted an approach to Morgan’s property and whether Morgan had control over it by designating it as parking for Airbnb guests. The appellate court affirmed parts of the lower court’s decision but reversed others, indicating that issues of fact regarding premises liability and proximate cause should be resolved by a jury.
