In a recent decision by the Court of Appeals of Georgia, the court reversed a trial court’s partial dismissal of David Cochran’s motion to suppress evidence in his DUI case. Cochran was charged with multiple offenses, including DUI and driving while disqualified. The trial court had previously dismissed part of his motion on the grounds that it lacked specificity as required by Georgia law. However, the appellate court found that Cochran’s motion provided sufficient notice to the state regarding the legal issues at hand, particularly concerning warrantless searches and the legality of a blood test conducted under a search warrant. The appellate court concluded that it was an error to dismiss portions of Cochran’s motion and reversed the lower court’s decision.
