Dimitrius Clemons’ appeal has been denied by the Court of Appeals of Georgia. Clemons sought a hearing on a 12-year-old motion to withdraw his guilty plea, which he had previously withdrawn. The court found no error in denying his request, affirming that once the motion was withdrawn, it ceased to exist. Clemons had initially pled guilty in 2010 to armed robbery and aggravated assault but later withdrew his motion to retract the plea during a scheduled hearing. His attempt to revive the motion over a decade later was rejected, with the court stating that any remedy would be through habeas corpus.
