In a recent ruling by the Court of Appeals of Georgia, the court upheld a summary judgment in favor of Timothy Spraggins, executor of the estate of Sylvia Spraggins, against claims brought by Eric Ferguson and David Ferguson. The case stems from a tragic automobile accident that resulted in the deaths of Amy Leigh Ferguson and Sylvia Spraggins. The plaintiffs argued that the trial court erred in discharging Spraggins’ estate from liability after they executed a limited liability release with Allstate Insurance Company and Progressive Insurance Company. The plaintiffs contended that under Georgia law, specifically OCGA ยง 33-24-41.1, the defendant should remain in the case to allow for full recovery from other defendants or insurance coverage. However, the court found no other insurance was available to cover claims against Spraggins’ estate following settlements with Allstate and Progressive. Consequently, the court affirmed the summary judgment, effectively releasing Spraggins’ estate from further liability.
