A former employee has filed a lawsuit against his previous employer, alleging discrimination based on age and disability. On February 20, 2026, Robert Erwin Jr. lodged a complaint in the United States District Court for the Northern District of Georgia against Eastern Glass and Aluminum Inc., claiming violations of the Age Discrimination in Employment Act (ADEA) and the Americans with Disabilities Act (ADA).
Robert Erwin Jr., who worked as a CAD Designer/Operator Programmer at Eastern Glass and Aluminum Inc. from January 30, 2022, until his termination on December 10, 2024, alleges that he was subjected to discriminatory practices due to his age and medical conditions. Born on August 1, 1965, Erwin was hired at the age of 56 and claims that despite his qualifications and satisfactory job performance, he faced age-related bias from his superiors. The complaint highlights several instances where derogatory comments were made about his age by company personnel. For example, Mr. Lee allegedly remarked about getting rid of “old fuckers,” directly referencing Erwin during a conversation with another supervisor.
In addition to age discrimination, Erwin asserts that Eastern Glass and Aluminum failed to accommodate his disabilities adequately. He suffers from hidradenitis suppurativa and trauma-induced dyslexia—conditions that affect major life activities such as walking, standing, concentrating, reading, and working. Despite disclosing these conditions during his initial interview and requesting reasonable accommodations like ergonomic equipment and flexible scheduling for medical appointments upon returning from medical leave in January 2024 after a car accident in August 2023, Erwin claims these requests were ignored or denied by the company.
Erwin’s legal action seeks various forms of relief from the court: back pay for lost wages due to alleged wrongful termination; reinstatement or front pay if reinstatement is not feasible; compensatory damages for emotional distress; punitive damages for willful violations of federal laws; liquidated damages under ADEA provisions; attorney’s fees; costs associated with litigation; and an injunction preventing further unlawful employment practices by Eastern Glass and Aluminum Inc.
