Former Employee Alleges Age Discrimination Against Major Corporation

A former employee has filed a lawsuit against a major corporation, alleging age discrimination and retaliation following his termination. Brian P. Kime, represented by The Forsythe Law Firm, LLC, lodged the complaint on February 26, 2026, in the United States District Court for the Northern District of Georgia against Carrier Corporation.

Brian P. Kime, a retired U.S. Army officer and former Associate Director at Carrier Corporation, claims he was unlawfully terminated on October 22, 2024, as part of an alleged restructuring that disproportionately affected employees over forty years old. Kime argues that this action violated the Age Discrimination in Employment Act (ADEA) of 1967. According to the complaint, all employees selected for layoff were over forty years old while younger employees were retained or hired for similar roles shortly after the layoffs. Notably, within five months of his termination, Carrier posted a job listing for a position identical to Kime’s previous role and filled it with someone under forty.

Kime also accuses Carrier of providing false information in separation paperwork required by the Older Workers Benefit Protection Act (OWBPA), which he contends misrepresented the scope and nature of the layoffs. The company later admitted to inaccuracies in these documents during an Equal Employment Opportunity Commission (EEOC) investigation but failed to correct them fully.

In addition to age discrimination claims, Kime alleges retaliation after he filed an anonymous ethics complaint against Kathleen McFetridge, then Vice President of Shared Services at Carrier. The complaint highlighted fabricated metrics related to his team’s performance. Following this complaint and other similar grievances from colleagues against McFetridge—who was later terminated—Kime’s position was eliminated in what he describes as retaliatory action.

The lawsuit seeks various forms of relief including back pay, front pay or reinstatement, liquidated damages for willful violations of ADEA provisions, and attorney fees. Kime requests declarations that Carrier violated ADEA by terminating him due to age and retaliating against him for opposing unlawful practices.
