Former Employee Alleges Discrimination Against Major Automotive Company Under ADAAA

In a striking legal battle, an individual is taking on a major automotive company over allegations of discrimination and wrongful termination due to disability. On November 17, 2025, Luther Perry filed a complaint in the United States District Court for the Northern District of Georgia against AutoNation Imports of Lithia Springs, LLC, operating as AutoNation Toyota Thornton Road. The lawsuit claims that the defendant violated Perry’s rights under the Americans with Disabilities Act Amendments Act (ADAAA).

According to the complaint, Perry was employed by AutoNation as a Service Porter starting September 1, 2022. His tenure with the company took a turn following a serious car accident on May 25, 2023, while he was traveling as a passenger in a vehicle owned by his employer. This incident resulted in significant injuries that affected his ability to perform major life activities such as walking and lifting. Despite informing his employer about his condition and continuing to work through pain, Perry alleges that he faced discrimination and was eventually terminated in March 2024 after declining a settlement offer tied to his workers’ compensation claim.

Perry contends that his medical conditions—radiculopathy affecting various spinal regions and associated pain—qualify as disabilities under federal law. He accuses AutoNation of failing to provide reasonable accommodations or engage in an interactive process to explore possible solutions for his continued employment. Instead, he claims that the company wrongfully terminated him based on his disability and refusal to accept their settlement offer without proper accommodation.

The lawsuit seeks several forms of relief from the court. Perry is asking for declaratory judgment recognizing the unlawful employment practices by AutoNation, general damages for emotional suffering caused by these actions, punitive damages for willful misconduct by the defendant, special damages covering lost wages and benefits along with prejudgment interest, reasonable attorney’s fees and litigation expenses, and any other relief deemed appropriate by the court.
