In a compelling legal battle, a former employee is taking on a retail giant, alleging violations of her rights under federal disability and medical leave laws. Kristy Abercrombie filed a complaint against Wal-Mart Associates, Inc. in the United States District Court for the Northern District of Georgia on November 26, 2025. The lawsuit accuses Wal-Mart of discrimination and retaliation under the Americans with Disabilities Act (ADA) and interference with her rights under the Family and Medical Leave Act (FMLA).
The case revolves around Abercrombie’s employment as an Online Grocery Picker at Wal-Mart starting October 18, 2023. She suffers from degenerative disks and arthritis, conditions that affect her mobility and musculoskeletal system. On October 10, 2025, she was involved in a car accident that exacerbated these disabilities. Despite informing her employer about her condition and requesting medical leave through their third-party service provider Sedgewick, Abercrombie claims she was not informed about her eligibility for FMLA leave.
Abercrombie alleges that after being pressured to return to work despite her injuries, she discovered she had been terminated when checking the schedule on October 27, 2024. “Plaintiff has been subjected to discrimination and retaliation,” the complaint states, accusing Wal-Mart of using pretextual reasons to mask illegal actions against her.
The plaintiff is seeking comprehensive relief from the court including general damages for emotional suffering, special damages for lost wages and benefits, punitive damages for willful misconduct by Wal-Mart, liquidated damages related to FMLA claims, attorney’s fees, prejudgment interest, declaratory relief affirming violation of statutory rights by Wal-Mart, injunctive relief such as reinstatement or front pay in lieu thereof along with prohibition of further unlawful conduct.
