In a dramatic legal turn, a former employee has filed a lawsuit against her previous employers, alleging violations of the Fair Labor Standards Act (FLSA) and retaliatory termination. On January 14, 2026, Jessica Casto lodged a complaint in the United States District Court for the Southern District of Georgia against Stop N Stor, Inc., and Stefanie Dasher McCullough.
The lawsuit details Casto’s employment as a Marketing Manager at Stop N Stor from August 4 to November 25, 2025. Despite her title suggesting managerial duties, Casto claims her responsibilities were far from managerial. She was tasked with creating social media content, responding to online reviews, updating digital platforms, and supporting office operations under McCullough’s direction. Throughout her tenure, she reportedly worked over 70 hours per week without receiving overtime pay—a clear violation of FLSA standards that mandate one-and-a-half times the regular hourly rate for hours worked beyond the standard 40-hour workweek.
Casto alleges that after raising concerns about her misclassification as an overtime-exempt employee on November 25, 2025, she was promptly locked out of her work systems and terminated. This swift dismissal forms the basis of her retaliation claim under FLSA’s anti-discrimination provision. The complaint argues that this termination was directly linked to her protected complaint regarding unpaid overtime wages.
Seeking justice for these alleged wrongdoings, Casto is asking the court for several remedies. She demands unpaid overtime premiums along with liquidated damages equivalent to those unpaid wages. Additionally, she seeks compensatory damages for lost wages due to retaliatory termination and emotional distress suffered as a result. Her plea includes reinstatement or front pay if reinstatement is not feasible and coverage of reasonable attorney fees and litigation costs.
Representing Jessica Casto are attorneys Charles R. Bridgers and Matthew W. Herrington from Caldwell, Bridgers & Benjamin LLC in Atlanta, alongside S. Wesley Woolf from Woolf Law Firm in Savannah. The case is being heard by Judge RSB-CLR under Case ID: 4:26-cv-00010-RSB-CLR.
