A legal battle has emerged involving allegations of unpaid wages and unfair labor practices at a retail store in Atlanta. On February 3, 2026, Md. Ismail Hossain filed a complaint in the United States District Court for the Northern District of Georgia against Padma Bangla Inc., doing business as Discount Food Mart, and its owner Fakhrul Ahmed.
Md. Ismail Hossain, a former employee of Discount Food Mart, claims that he was subjected to numerous violations of the Fair Labor Standards Act (FLSA) during his employment from July 2021 until March 10, 2024. According to the complaint, Hossain regularly worked over 40 hours per week without receiving overtime pay as mandated by law. The plaintiff alleges that he typically worked approximately 84 hours each week, including around 44 hours of overtime for which he was not compensated. Additionally, Hossain accuses the defendants of failing to pay him any wages from December 15, 2023, through March 10, 2024. During this period, despite being required to work and remain on call during days off without compensation, Hossain claims he received no payment whatsoever.
The complaint further details how Hossain faced verbal abuse and threats from Fakhrul Ahmed after requesting his earned overtime wages. The plaintiff asserts that Ahmed used profane language and threatened him with deportation as retaliation for seeking rightful compensation. This hostile work environment allegedly culminated in Hossain’s termination on March 10, 2024—an action purportedly taken to avoid compliance with minimum wage requirements under FLSA.
Hossain is seeking several forms of relief from the court: unpaid minimum wages for the period he was uncompensated; unpaid overtime compensation at one and one-half times his regular rate; liquidated damages equal to these unpaid amounts; and damages for breach of contract based on an agreed hourly rate of $17.00 per hour. Furthermore, he requests reasonable attorney’s fees and costs incurred in bringing this action along with prejudgment interest on all unpaid wages and overtime compensation.
