In a recent decision by the Court of Appeals of Georgia, two non-parties, Ortho Sport & Spine Physicians, LLC and Medernix, LLC, successfully challenged a trial court’s order compelling them to produce extensive financial records in a personal injury case. The court found that the trial court had abused its discretion by requiring the creation of an overly broad database report that was not reasonably calculated to lead to admissible evidence. The appellate court vacated the orders compelling production and remanded for further proceedings. This decision highlights the balance courts must strike between discovery needs and protecting sensitive financial information.
