Jamel Lamarr Collins has filed a lawsuit against Monterrey Mex, Inc., after sustaining injuries in a car accident caused by Margaret Gorham, who was driving under the influence. The incident occurred in September 2019 when Gorham rear-ended Collins’ vehicle. Collins claims that Monterrey Mex served alcohol to Gorham, who was underage and visibly holding her car keys, thus implying she would soon be driving. Monterrey sought summary judgment on the grounds that they were unaware Gorham would drive after drinking. However, the trial court denied this motion, citing sufficient evidence for a jury to decide whether Monterrey had constructive knowledge of Gorham’s intent to drive. The Court of Appeals of Georgia upheld this decision.
