A lawsuit has been filed in the United States District Court for the Northern District of Georgia by Jason McCool against Hi-Tech Pharmaceuticals, Inc. The plaintiff alleges that Hi-Tech is illegally marketing and selling a product called Somatomax as a dietary supplement, despite it containing Phenibut, a psychoactive sedative banned in several countries and classified as a controlled substance in Alabama. The lawsuit claims that Hi-Tech misled consumers by not disclosing the dangerous side effects of Phenibut on Somatomax’s packaging, which includes addiction and withdrawal symptoms. McCool, who is recovering from addiction, purchased Somatomax believing it was safe but experienced negative health effects. The class-action suit seeks compensation for all affected consumers and punitive damages due to fraudulent misrepresentation.
