Joshua Banks has filed a lawsuit against Kerry, Inc. in the United States District Court for the Northern District of Georgia, alleging violations of the Americans with Disabilities Act (ADA) and the Family and Medical Leave Act (FMLA). The complaint claims that Banks was wrongfully terminated from his position at Kerry’s Rome, Georgia facility due to his disability and use of FMLA leave. Banks, who suffered from chronic medical issues following a spider bite, asserts that his absences were medically documented and approved but were still cited as the reason for his termination. He is seeking compensation for lost wages, emotional distress, punitive damages, and other relief.
