In a recent decision by the Court of Appeals of Georgia, Justin Hewett’s convictions for child molestation and sexual battery were upheld. Hewett was convicted by a jury for touching his four-year-old cousin inappropriately in 2019. On appeal, Hewett challenged the sufficiency of the evidence and claimed errors in trial court proceedings, including ineffective assistance from his counsel and failure to instruct the jury on lesser charges. The appellate court found that there was sufficient evidence to support the convictions, and it rejected claims that the convictions were mutually exclusive or that his legal representation was inadequate. Additionally, the court did not find plain error in failing to instruct the jury on simple battery as a lesser-included offense.
