In a recent decision by the Court of Appeals of Georgia, Kathy Boone’s appeal in a medical malpractice case was denied. Boone had filed the suit following the death of her mother, Paula Thacker, who suffered debilitating injuries after a series of small strokes. The defendants included Vascular Surgical Associates, Northwest Neurology, P.C., and several doctors. Boone argued that the trial court erred by allowing an unqualified defense expert to testify and by giving certain jury instructions. However, the court found no abuse of discretion in qualifying Dr. Karen Quirk as an expert witness and upheld the jury instructions provided during the trial. Consequently, the jury’s verdict in favor of the appellees was affirmed.
