Margie Pollard’s appeal against Greg Deloach in the Court of Appeals of Georgia has resulted in a reversal of the trial court’s summary judgment. Pollard was injured in April 2020 when a step broke on an exterior staircase of her apartment building, owned by Deloach. The trial court had initially ruled in favor of Deloach, stating no liability under OCGA § 44-7-14 for out-of-possession landlords. However, the appellate court found that there were genuine issues regarding whether Deloach had constructive knowledge of the hazardous condition under general premises liability principles (OCGA § 51-3-1). The case will proceed to address these factual disputes.
