In a recent decision by the Court of Appeals of Georgia, American Multi-Cinema, Inc. (AMC) successfully appealed a trial court’s denial of their motion for summary judgment in a premises liability case filed by Marie Gillis. The case centered around an incident where Gillis fell at an AMC theater due to the absence of a handrail on certain stairs. Despite Gillis’s claims that AMC was negligent for not having handrails in compliance with building codes, the appellate court found that the lack of a handrail was an “open and obvious” condition. The court ruled that Gillis had equal knowledge of this hazard, thus entitling AMC to summary judgment and reversing the trial court’s decision.
