In a shocking case of alleged school misconduct, a mother has taken legal action against a school district after her son was reportedly assaulted by a school resource officer. On February 23, 2026, Klynne Winn filed a complaint in the United States District Court for the Northern District of Georgia against the DeKalb County School District and other associated defendants.
The lawsuit stems from an incident on April 11, 2024, when A’Siye Loper, a 12-year-old student at Miller Grove Middle School, was allegedly assaulted by Robert Hyson, a campus supervisor employed by the DeKalb County School District. According to the complaint, Hyson approached Loper without provocation and placed him in a chokehold. This act reportedly caused Loper to fall, suffer a seizure, and sustain injuries including chipped teeth and damage to his ankle and knee. The complaint further alleges that Hyson falsely reported to Winn that her son had fallen on his own. After learning the truth from her son, Winn demanded an investigation into the incident.
The investigation revealed troubling findings: several students witnessed Hyson’s actions, which were described as horseplay but deemed unprofessional by investigators. It was also noted that Principal Sharon Evans was aware of Hyson’s aggressive behavior yet allowed him to remain employed. As a result of these findings, Hyson was terminated on May 29, 2024.
Winn’s lawsuit includes multiple causes of action such as violation of civil rights under 42 U.S.C. § 1983 for excessive force and substantive due process violations against all defendants; municipal liability under Monell claim against the DeKalb County School District; assault and battery claims against Hyson and vicariously against the school district; intentional infliction of emotional distress; negligent hiring, retention, and supervision; and respondeat superior claims holding the school district accountable for its employee’s actions.
Winn is seeking compensatory damages for physical injuries and emotional distress suffered by her son as well as punitive damages against Hyson. She also seeks injunctive relief requiring mandatory de-escalation training for staff within the DeKalb County School District to prevent future incidents like this one. Additionally, she requests reasonable attorneys’ fees and costs pursuant to federal law.
