A dedicated educator with a nearly three-decade-long career at a public university finds himself embroiled in a legal battle after being forced into retirement under controversial circumstances. Dr. Brian L. Gerber filed a complaint on December 4, 2025, in the United States District Court for the Middle District of Georgia against The Board of Regents of the University System of Georgia, Dr. Richard A. Carvajal, and Heidi Cox, alleging violations of his rights and seeking redress for damages incurred.

Dr. Gerber’s lawsuit tells a compelling story of alleged mismanagement and scapegoating within Valdosta State University (VSU), where he served as a tenured professor and director of the STEAM Center for Applied Creativity and Innovation. His involvement with various community initiatives, including running a 501(c)(3) organization linked to VSU and organizing an annual fundraiser for the Valdosta Early College Academy, highlights his commitment to education and community service. However, during an audit led by Heidi Cox in 2024, supposed accounting errors were identified in programs managed by Dr. Gerber, leading to accusations of misappropriation of state funds and fraud.

Despite fully cooperating with the investigation by participating in interviews and providing requested documentation, Dr. Gerber was ultimately offered an ultimatum: face termination or retire “with full benefits.” Believing that retirement would preserve his reputation and future employment prospects within the University System of Georgia (USG), he chose to retire but later discovered he had been designated “ineligible for rehire” without notice or due process.

Dr. Gerber’s complaint accuses VSU officials of violating his procedural due process rights under 42 U.S.C. § 1983 and breaching his employment agreement by not honoring the terms of his retirement package. Additionally, he asserts claims against Heidi Cox for defamation based on her presentation to USG’s Office of Internal Audit that allegedly contained false statements about him misappropriating funds.

The plaintiff seeks several forms of relief from the court: reinstatement or removal of the “ineligible for rehire” designation; compensatory damages for lost wages and benefits; punitive damages; attorney’s fees; expenses related to litigation; and any other relief deemed appropriate by the court.
