In a dramatic legal confrontation, United Healthcare Services, Inc. has accused RG Anesthesia, LLC of exploiting federal legislation to unjustly enrich itself. On January 30, 2026, United Healthcare filed a complaint in the United States District Court for the Northern District of Georgia against RG Anesthesia. The lawsuit centers around allegations that RG Anesthesia is misusing the No Surprises Act (NSA), a law designed to protect patients from unexpected medical bills, by submitting ineligible claims to secure excessive payments.

United Healthcare’s complaint paints a picture of deliberate manipulation by RG Anesthesia. According to the filing, RG Anesthesia has been fraudulently submitting claims under the NSA’s Independent Dispute Resolution (IDR) process that are not eligible for such consideration. The NSA was intended to mediate fair payment disputes between out-of-network providers and health plans for commercial insurance claims only, excluding Medicare and Medicaid-related claims. However, United alleges that RG Anesthesia knowingly submitted Medicare Advantage claims as if they were eligible for IDR resolution, thus securing “windfall awards” unjustly.

The crux of United’s argument is that these actions by RG Anesthesia are not isolated incidents but part of a broader scheme to inflate profits at the expense of healthcare systems and patients. The complaint highlights a specific case involving a 74-year-old patient who underwent an endoscopy procedure covered under a Medicare Advantage plan administered by United. Despite clear indications on both the patient’s insurance card and subsequent communications that this was a Medicare claim—and therefore ineligible for IDR—RG Anesthesia proceeded with the IDR process through its agent Radix Health.

United Healthcare seeks declaratory judgment from the court affirming that Medicare and Medicaid claims are not subject to NSA IDR processes and requests an injunction preventing RG Anesthesia from continuing such practices. Additionally, United is pursuing damages related to administrative fees paid during these fraudulent proceedings and seeks protection against future fraudulent submissions by RG Anesthesia.
