Tony H. Shoaf, a former employee of a prominent auto dealership, has filed a lawsuit alleging discrimination based on disability. The complaint was lodged by Shoaf in the United States District Court for the Northern District of Georgia on December 28, 2025, against SONS Auto Holdings, LLC, doing business as BMW of South Atlanta. This legal action brings to light serious allegations under the Americans with Disabilities Act (ADA), claiming that Shoaf faced wrongful termination due to his medical condition.

The case details how Tony H. Shoaf, who served as a Service Manager at BMW of South Atlanta from January 15, 2021, until his termination on October 4, 2021, experienced discriminatory practices following his diagnosis with a brain tumor in June 2021. According to the complaint, despite having led the service department to break records and receiving commendations and a raise for his performance in May 2021, Shoaf began facing exclusion and eventual job loss after disclosing his health condition to his supervisor. Notably, on August 17, 2021, he discovered through a friend that his position was being advertised while he was still employed and assured otherwise by his supervisor.

Shoaf contends that there were no performance issues communicated to him prior to this revelation or before his termination. He alleges that the defendant fabricated concerns about his work performance post-diagnosis as pretext for discrimination based on disability—a violation of federal law protecting employees with disabilities from unfair treatment in the workplace. The lawsuit claims that these actions were carried out with malice or reckless indifference to Shoaf’s federally protected rights.

In seeking justice through this court filing, Shoaf is requesting several forms of relief: back wages and benefits owed at trial time; front pay or reinstatement; compensatory damages for emotional distress; punitive damages; prejudgment interest; costs; and reasonable attorney’s fees.
