In a striking legal battle, an employee is taking on her former employer over allegations of discrimination and retaliation. Tanya Porcena filed a complaint against Pennrose Management Company in the United States District Court for the Northern District of Georgia on November 18, 2025. The lawsuit accuses Pennrose Management Company of violating the Family and Medical Leave Act (FMLA) and the Americans with Disabilities Act (ADAAA), as amended.
Porcena’s story begins with her employment as Regional Vice President at Pennrose Management Company, starting on February 22, 2021. She claims that despite performing her job well, she required additional support due to a disabling medical condition. Her requests for accommodations were allegedly ignored by the company. The situation worsened when Porcena experienced a serious health issue on February 6, 2023, which led to hospitalization later that month. Consequently, she was granted FMLA leave from February 6 to March 19, 2023. Upon returning to work on March 20, her health issues persisted, prompting another FMLA leave from May 9 to July 5, 2023.
The complaint details how Porcena was demoted during her second FMLA leave and subsequently terminated the day after it ended on July 6, 2023. She alleges that these actions were direct results of her disability and use of FMLA leave. “Defendant terminated Plaintiff because of her disability and because of her FMLA leave,” states the complaint.
Porcena is seeking various forms of relief from the court: back pay and benefits, compensatory damages for emotional distress, punitive damages if permissible, injunctive relief to prevent further violations by Pennrose Management Company, and coverage for attorney fees and litigation costs. The complaint underscores that Porcena has complied with all procedural prerequisites before filing this action.
