Plaintiff alleges jail officials’ failure led to severe injury

A Georgia man has filed a lawsuit alleging severe negligence and violation of his civil rights while incarcerated. John S. Ross, the plaintiff, filed a complaint in the United States District Court for the Northern District of Georgia on February 20, 2026, against Frank Reynolds and other officials associated with the Cherokee County Detention Center (CCDC). The lawsuit accuses these officials of failing to protect him from inmate violence and neglecting his serious medical needs following an attack.

According to the complaint, Ross was attacked by fellow inmates at CCDC on March 8, 2023, after officers discovered contraband in his cell based on information he had provided. Despite hearing threats from his cellmates and observing pre-fight indicators, officers allegedly took no action to protect him. The attack left Ross unconscious with a broken jaw in two places and a concussion. Following the assault, Ross was taken to Northside Hospital Cherokee for emergency treatment. The attending physician arranged for follow-up care with an oral surgeon due to the severity of his injuries. However, despite repeated requests by Ross for transport to this appointment on March 9, 2023, the defendants failed to facilitate it.

The lawsuit further details that when Ross was finally transported to Georgia Oral & Facial Reconstructive Surgery (GOFRS) on March 15, 2023, surgery was deemed necessary. However, due to previous delays in payment by Sheriff Reynolds for inmate care at GOFRS, a deposit was required before scheduling surgery. Sheriff Reynolds allegedly refused to pay this deposit promptly, resulting in Ross’s surgery being delayed until April 5, 2023—nearly a month after his injury occurred. By then, his jaw had healed improperly and required re-breaking during surgery.

Ross’s complaint highlights systemic issues within CCDC regarding compliance with medical care policies and practices that led to delays or denials of necessary medical treatment for inmates. It accuses various supervisory defendants of failing to correct these unconstitutional customs and practices despite their knowledge of them.

The plaintiff seeks compensatory damages for all harm suffered due to these alleged constitutional violations as well as punitive damages against each defendant individually for their conduct. Additionally, he requests reasonable attorneys’ fees and costs related to litigation under applicable law.
