A collective action lawsuit has been filed against a logistics company, accusing it of failing to pay its delivery drivers their rightful wages and overtime. The complaint was lodged by Jy’Tavius Maynard on December 11, 2025, in the United States District Court for the Northern District of Georgia against Deera Express Inc. and its founder Ramesh Bikkani. This legal battle highlights significant allegations of wage violations under the Fair Labor Standards Act (FLSA).
The plaintiff, Jy’Tavius Maynard, claims that Deera Express Inc., along with its CEO Ramesh Bikkani, systematically failed to compensate him and other similarly situated employees for overtime work. According to the complaint, these employees were parcel delivery drivers working primarily within metro-Atlanta under a contract with FedEx Corporation. Despite regularly working more than 40 hours per week, the drivers were allegedly paid only for a maximum of eight hours per day and 40 hours per week at an hourly rate of $16.00. Maynard argues that this practice violates FLSA provisions requiring payment of one and a half times the regular rate for overtime hours.
Maynard’s complaint further alleges that Deera Express Inc., a Georgia-based corporation with annual sales exceeding $500,000, employed non-exempt hourly workers who should have been entitled to overtime pay under federal law. The lawsuit contends that both Deera and Bikkani were aware of the drivers’ extended work hours but deliberately chose not to compensate them accordingly. “Defendants willfully failed to calculate the Drivers’ overtime rates of pay using the Drivers’ actual hours worked,” states the complaint.
In seeking justice, Maynard is requesting that the court certify this as a collective action under FLSA rules, allowing other affected drivers to join the lawsuit. He demands judgment against Deera Express Inc. and Ramesh Bikkani for unpaid wages over three years, liquidated damages equal to those unpaid wages, reasonable attorney’s fees, costs, expenses, pre-judgment interest, and incentive payments for bringing forth this action.
Representing Maynard are attorneys John L. Mays and James D. Dean from Parks Chesin & Walbert P.C., based in Atlanta. The case is presided over by Judge Richard W. Story in Case No: 2:25-cv-00394-RWS.
