Cesar Lopez filed a complaint on January 5, 2026, in the United States District Court for the Northern District of Georgia against Cook Out GA, Inc., alleging violations of the Americans with Disabilities Act (ADA).
Cesar Lopez’s story begins with his employment as a Manager in Training at Cook Out GA, Inc., where he developed carpal tunnel syndrome after being required to work long hours without breaks. Despite informing Cook Out of his need for surgery and requesting accommodations, Lopez was abruptly fired the next day for alleged “insubordination.” This termination came after Lopez had already notified the company about his health issues and need for accommodation, which he believes was a direct violation of ADA laws. The lawsuit highlights that Cook Out failed to engage in an interactive process or provide any reasonable accommodations as required by law. Lopez asserts that prior to his dismissal, there were no indications from Cook Out regarding any performance issues or insubordinate behavior.
Lopez is seeking several forms of relief from the court. He requests back pay including lost wages and benefits, compensatory damages for emotional distress, and punitive damages aimed at deterring future unlawful conduct by Cook Out. Additionally, Lopez seeks front pay or reinstatement along with reasonable attorneys’ fees and costs associated with bringing this action forward. His complaint also demands a jury trial to address these grievances.
