Randall Buchanan’s conviction for failing to register as a sex offender has been overturned by the Court of Appeals of Georgia. The court found that the state did not provide sufficient evidence to prove Buchanan failed to update his employment information within the required 72-hour timeframe after a change in employment status. Although Buchanan admitted to working part-time for his father, the state could not establish when this employment began or how frequently he worked, which was necessary to prove a violation of OCGA § 42-1-12 (f) (5). Consequently, the court reversed Buchanan’s conviction.
