Roodson Fleureme’s lawsuit against the City of Atlanta and city employee Dwayne De Jonge has been dismissed by the Court of Appeals of Georgia. Fleureme claimed he was injured when De Jonge, operating a city vehicle, failed to yield and struck him on a public sidewalk. The dismissal came after the court found that Fleureme did not properly serve an ante litem notice to the mayor or chairperson of the city council as required by law. Although Fleureme attempted to serve notices via Federal Express to various city offices, the court ruled these did not meet statutory requirements. Consequently, his appeal was denied, affirming the trial court’s decision.
